Five year prison term for Centerville man

CENTERVILLE — A Centerville man was sentenced to five years in state prison Sept. 24 for multiple drug convictions.

Roy Andrew Heartley, 48, was charged by Appanoose County Attorney Richard Scott on July 25, 2013 with four criminal offenses all with an offense date of June 22: Manufacture, deliver, possess with intent to manufacture or deliver less than five grams of methamphetamine, second offense, a class C felony; possession of morphine, second offense, an aggravated misdemeanor; possession of dilaudid, second offense, an aggravated misdemeanor; and possession of alprazolam, second offense, an aggravated misdemeanor.

Judge Lucy Gamon sentenced Heartley Sept. 24 on three of those charges and dismissed one. The judge sentenced Heartley to two years each in state prison for the meth and morphine charges and one year for the alprazolam charge, with the terms to run consecutively with each other.

The court dismissed the dilaudid charge.

Also, Judge Gamon on Sept. 24 found Heartley had violated his probation for a class D controlled substance charge that was adjudicated on Jan. 7, 2011 to five years in prison suspended to five years probation and revoked the probation and ordered those five years to run concurrently with the five year prison sentence she just imposed. Records show Heartley had violated his probation three time on that case before Judge Gamon imposed the original sentence.

The criminal complaint affidavit filed by a Centerville Police Department officer on June 23, 2013, states at 11:25 p.m. on June 22 a law officer encountered Heartley in the 200 block of East Maple Street while investigating a suspicious persons complaint outside True Value.

The reporting officer states the defendant hid between two parked cars in a nearby car lot and disposed of several drugs, including two grams of methamphetamine, 12 morphine tablets, 8.5 tablets of alprazolam and one dilaudid tablet. While the defendant was detained, police discovered in his possession a marijuana pipe and $950.

It was also determined the defendant had an outstanding local arrest warrant for probation violation.

Dilaudid is a strong pain killer and alprazolam is used to treat anxiety and panic disorders.

Heartley owes $2,827.75 for the case adjudicated in September and $5,824.99 from the case adjudicated in January of 2011.
